COPYRIGHTS AND TRADEMARKS

You’re solely responsible for your designs along with other images, graphics, text, or materials. Therefore, don’t use the text, image, design, trademark, service mark, or copyrighted work of a third party without their consent. By submitting your requirements, you guarantee that your Products do not violate the rights of any third party, such as copyright, trademark, publicity rights, or privacy rights. Other than that, your content should abide by ethical guidelines and must not contain any content that could defame or libel any third party. Also, if you submit the work of a third party, you are assured that you have the right to use their content with their consent. 

By placing an order on this Site, you confirm that you have the permissions, rights, and authority to proceed with the order, and you authorize Den Packaging™ to produce the Products on your behalf.

CUSTOMER CONTENT

The content the customer shared with Den Packaging.com™ is the sole responsibility of the person who submitted it. Therefore, you are accountable for all Content you send, upload, post, or transmit via the website. By submitting your content, you agree to comply with all local regulations regarding online conduct and acceptable Content. You also assure that you’ll not submit any indecent and unlawful content or infringe upon the intellectual property rights or other proprietary rights of Den Packaging.com™ or any third party. 

 

Den Packaging™ is not responsible for Customer-posted Content and does not guarantee the accuracy, integrity, or quality of such Content. Den Packaging.com™ will not be responsible for any immoral and indecent Content you may encounter. Privacy is our key priority. You are responsible to protect your password. You take responsibility for all the orders that are placed from your registered account.

 

When you or someone with access to your account orders a print item using your password, you grant Den Packaging.com™ a worldwide, royalty-free, non-exclusive license to use, reproduce, sublicense, modify, adapt, publish, display, and create derivative works from the Content on the website and the printed product. This license is granted for purposes such as storing designs or processing print orders.

 

You abide by the rule that Den Packaging™ and its designees can remove any Content that violates the terms of service or may be objectionable. Den Packaging.com™ may retain Content and disclose it if required by law or if such disclosure is necessary to: 

(a) align with the legal proceedings; 

(b) enforce the terms of service; 

(c) respond to claims that the Content violates third-party rights; or 

(d) protect the rights, property, or safety of Den Packaging.com™, its users, and the public.

DESIGN FILES

Den Packaging.com™ only deals with design files at 72 DPI (low resolution). If you’re interested in purchasing higher-resolution designed files, please contact sales@Denpackaging.com for a quote.

CUSTOMER SUBMITTED ARTWORK

When submitting your design, make sure that all artwork is provided in CMYK format with a minimum resolution of 300 DPI. Den Packaging.com™ is not responsible if any variation occurs during file conversion from RGB to CMYK. Moreover, the company doesn’t take any responsibility for printing issues like fuzziness, distortion, or pixelation that result from customer-provided artwork.

PROOFING & MATCHING

Customers have to approve the work after printing for the final artwork. Once the order is in process, final artwork proofs and a job specification sheet will be emailed to customers. It's the customer's responsibility to review all details in the specification sheet, including delivery dates and production speed, and confirm that all requirements are accurately noted. 

Den Packaging.com™ does not take responsibility for anything other than mentioned in the final specification sheet. Customers must also review the final artwork proof for accuracy, including spelling and design elements. However, changes might occur during file preparation. The final proof represents what will be printed, so it's recommended to print it out at 100% scale for verification. 

Den Packaging.com™ will not be responsible for any issue if not identified by the customer and promptly communicated. Upon approval, the design and specifications will be sent to production and printed as approved.

Den Packaging.com™ does not guarantee color matching or ink density on screen proofs approved by customers. The basic purpose of screen proofs is to match layout and text accuracy but not color or density. Den Packaging.com™ will try its best to keep the gradient density in duo-tone prints the same but will not be liable to provide the exact final appearance unless a color match proof is ordered. The lamination may change the printed colors, and Den Packaging.com™ is not responsible for the color of laminated products.

MATERIALS

The material used for printing does not meet the food-grade standards. Communicate beforehand if you’ve any specific requirements. 

CUSTOMER IS RESPONSIBLE FOR PROOF AND LAYOUT APPROVAL BEFORE THE PRINTING.

Den Packaging™ is NOT LIABLE for errors in a printed product caused by any of the following:

·         Graphics Orientation or Placement and Incorrect Font Usage

·         Spelling, Grammatical, and Punctuation Errors

·         Wrong Die cuts, slits, or Incorrect and Missing Folds

·         Finished Product Size

COLOR ACCURACY AND HARDCOPY PROOFS

Den Packaging.com™ aims to meet the submitted colors as closely as possible. However, the printing process has a few drawbacks that may cause color variations. The color accuracy is guaranteed to be within 90% of the final proof you approved. The Den Packaging can only assure color accuracy for your print-ready files if you opt for a hardcopy proof at an additional cost. Additionally, Den Packaging is not liable for color differences between submitted print-ready images and the actual artwork or product they represent.

INDEMNITY

You agree to indemnify and defend Den Packaging.com™ and its stakeholders like licensors, directors, officers, and employees against all claims, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from 

(i) your violation of these Terms and Conditions or 

(ii) any suit, claim, or demand arising from or related to any text, photograph, image, graphics, or other material you included in Products that was not part of the standard Site Content.

ORDER CANCELLATION

You can cancel your order before printing or shipping. However, once the product is shipped, you can’t cancel the order. For cancellation at the different production stages, you’re responsible for charges. The order phases are;

  1. Orders are placed online.
  2. Orders are processed in our design department.
  3. Orders sent to print.
  4. Orders are collected by the shipping firm.

All cancellations are permitted before stage 2. 

  • If canceled in stage 1, you’re required to pay a fee of $15 plus 5% of the total amount covers processing, bank charges, and design department fees. 
  • For cancellations in stage 2, you’ve to pay a minimum fee of 20% of the total order amount applied to cover design department costs. 
  • You can try to cancel your order at stage 3, but a minimum fee of 50% of the total order amount is deducted. 
  • Orders in stage 4 cannot be canceled.

DESIGN ORDERS

Once an order has been placed successfully, No Refunds are issued for any design services orders.

RETURNS AND REFUNDS

As all orders are unique, All Sales are final. If we verify that we made an error, we will re-print the order. No Refunds or Credits.

REPRINTS

If there’s any defect or error in the final product, customers are obliged to notify Den Packaging.com™ within 3 business days of order delivery. Claims after the given timeframe won’t be entertained. 

To replace the products, customers must return at least 99% of the received product within 10 days of the initial delivery date, at their own expense, but after receiving written return authorization from Den Packaging.com™. All charges related to expedited printing (rush printing or shipping) are non-refundable, including those for orders returned for any reason. No exceptions will be made.

ORDER SHIPPING AND DELIVERY

Den Packaging.com™ offers the following product options when placing an order:

Standard

For standard orders, shipping time is not guaranteed. 

Free Ground Shipping within 48 contiguous states.

Usually Ships within 10 to 15 business days after final proof approval.

Priority 

Guaranteed to ship the order within 8 business days:

FREE Ground shipping is included within 48 contiguous states.

Products will be shipped within 8 business days after final proof approval

Express

Guaranteed to ship within 6 business days

FREE Ground shipping is included within 48 contiguous states.

Products will be shipped within 6 business days after final proof approval

Make sure you send final approval by a maximum of 11:00 AM EST otherwise one business day will be added to the shipping times.

Den Packaging.com™ try to send your orders as quickly as possible. However, you must cooperate if encounter any unforeseen events like a natural disaster, shipping company delays, international customs issues, or any other circumstances beyond our control. Other than that, delivery might be delayed due to equipment failures, malfunctions, or technical problems. Under such conditions, the company will refund rush charges expedite fees, or waive them where applicable. 

Orders cannot be canceled due to these delays.

Delivery dates are based on estimates from our suppliers and recent order history.

Den Packaging.com™ is not responsible for delays in production, shipping, or delivery of products. Customers agree to pay all customs duties and fees for goods shipped to their locations. It is the customer's responsibility to arrange customs clearance for shipments delivered outside the United States.

DAMAGED AND LOST PACKAGES

Make sure you check your order for visible signs of damage or missing items compared to the enclosed packaging slips or invoices before accepting delivery. In case of damage or missing items, notify Den Packaging.com™ and the delivery courier on the spot. Den Packaging.com™ will not be responsible for any claims of damage or missing items not filed by the customer. Also, the company is not responsible for errors, omissions, lost, or damaged shipments caused by third-party shippers.

Each order has some extra pieces without extra charges to avoid any mishandling. However, printing industry standards allow for underages or overages of up to 5%. Therefore, if the exact quantity is required, it is recommended that customers order 10% more than needed. If packages need to be reshipped due to an error in the provided shipping address, additional shipping and handling charges will apply.

DISCLAIMER OF WARRANTY

The site and its content are provided "as is" without any warranty, either expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that the site's operation may not be uninterrupted or error-free. References and links to products or services of independent companies may appear on the site, and these are provided "as is" without any warranty, either expressed or implied.

LIMITATION OF LIABILITY

Den Packaging.com, along with its stakeholders like licensors, suppliers, vendors, officers, directors, employees, or agents, shall not be liable for any consequential damages of any kind. This includes any damages from data loss or profits. This limitation applies to damages arising from the use or performance of the site, or from the failure to provide products or services ordered from Den Packaging.com or its affiliates, including damages from mistakes, omissions, viruses, delays, or service interruptions.

Additionally, Den Packaging.com is not liable for any damages or consequences resulting from your inappropriate or unauthorized use of the site or its content.
